Welcome to cocogardensupply.com (the "Site"), operated by Coco Garden Supply LLC ("we," "us," or "our"), a limited liability company registered in the State of Florida. These Terms of Service ("Terms") govern your access to and use of our Site, products, and services.

By accessing or using our Site, placing an order, or requesting a quote, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Site.

1. Use of the Site

You must be at least 18 years of age to use this Site and place orders. By using the Site, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding agreement.

Product colors shown on screen may vary slightly from the actual product due to monitor settings and photographic conditions.

All prices listed on the Site are in United States Dollars (USD) unless otherwise stated. Prices are subject to change without notice. For products listed as "Price on Request" or requiring a quote, pricing will be provided after you submit a quote request and will be valid for the period stated in the quote.

2.3 Availability

All products are subject to availability. We reserve the right to limit quantities, discontinue products, and refuse or cancel orders at our discretion. If a product you ordered is unavailable, we will notify you and offer an alternative or a full refund.

3. Orders

3.1 Order Acceptance

Placing an order through the Site constitutes an offer to purchase. All orders are subject to acceptance by Coco Garden Supply. We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in pricing or product information, or suspected fraudulent activity.

3.2 Order Confirmation

Upon placing an order, you will receive an email confirmation with your order details and order number. This confirmation acknowledges receipt of your order but does not constitute acceptance. Your order is accepted when we confirm it by a separate communication (email or phone) and begin preparing it for delivery.

3.3 Order Accuracy

4. Payment

4.1 Payment Methods

We currently accept payment on delivery (COD) and invoicing. Additional payment methods, including credit card payments via Stripe, may be added in the future. Accepted payment methods will be displayed during checkout.

4.2 Payment Terms

For orders placed through the online shop, payment is due upon delivery unless other arrangements have been made in advance. For commercial accounts with approved credit terms, payment is due according to the terms specified in your account agreement (e.g., Net 30).

4.3 Taxes

Prices displayed on the Site may or may not include applicable sales tax. Florida state sales tax and any applicable local taxes will be calculated and added to your order total at checkout where required by law.

5. Delivery

5.1 Delivery Area

We deliver to Miami-Dade, Broward, and Palm Beach counties in Florida. Delivery availability and fees vary by location. Delivery fees, if applicable, will be communicated during the quote process or at checkout.

5.2 Delivery Schedule

Delivery dates and times are estimates and not guaranteed. We will make reasonable efforts to deliver your order within the estimated timeframe. Delays may occur due to weather, traffic, equipment issues, or other circumstances beyond our control.

5.3 Delivery Acceptance

You or an authorized representative must be available to accept delivery at the specified address. If no one is available at the time of delivery, we may leave the materials at the designated location at our discretion, or reschedule delivery for an additional fee.

5.4 Inspection

You should inspect your order upon delivery. If you notice any damage, shortages, or defects, you must notify us within 24 hours of delivery. Claims made after 24 hours may not be honored.

6. Returns, Refunds, and Cancellations

6.1 Order Cancellation

You may cancel an order at no charge if the cancellation request is made before the order has been loaded for delivery. Orders that have already been loaded or are in transit cannot be cancelled. Contact us by phone at (305) 960-7682 to request a cancellation.

6.2 Returns

Due to the nature of our products (mulch, compost, soil, and other landscaping materials), returns are generally not accepted once the product has been delivered. Exceptions may be made for damaged or incorrect products as described below.

6.3 Damaged or Incorrect Products

If your order is delivered damaged or contains incorrect products, contact us within 24 hours of delivery. We will arrange for replacement or credit at no additional cost to you. Please retain the original product and packaging for inspection if requested.

6.4 Refunds

Refunds, when applicable, will be processed using the original payment method within 7 to 10 business days. For COD orders, refunds will be issued by check or credit to your account, as applicable.

7. Quote Requests and Service Requests

Quote requests and service requests submitted through the Site are not binding orders. They are inquiries that we will respond to within 24 hours during business days. Quotes provided are valid for the period stated in the quote communication (typically 7 to 14 days) unless otherwise noted.

8. Intellectual Property

All content on this Site, including text, graphics, logos, images, icons, and software, is the property of Coco Garden Supply LLC or its content suppliers and is protected by United States and international copyright laws. You may not reproduce, distribute, modify, or create derivative works from any content on this Site without our prior written consent.

9. Limitation of Liability

To the fullest extent permitted by law, Coco Garden Supply LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising from or related to your use of the Site, our products, or our services.

Our total liability for any claim arising from or related to these Terms, our products, or our services shall not exceed the total amount you paid to us for the specific order or service giving rise to the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless Coco Garden Supply LLC, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorney fees) arising from your use of the Site, your violation of these Terms, or your violation of any rights of a third party.
